- Tax disputeIncome Tax Authority-Central Circle-1(3) MumbaiSince 28 Jan 2019Matter pending before the Commissioner of Income Tax (Appeals)
At the filing before: The Assessing officer (Ld. A.O.) had levied a penalty of Rs.32,81,613/- u/s.271(1)(c) of the Income Tax Act 1961 for alleged concealment of income and for filing inaccurate particulars of income vide his order dated 28.12.2018. The Ld. AO had failed to appreciate the fact that the additions made by the Ld. AO vide order passed u/s 143(3) of the Act were itself incorporated in the order passed u/s 143(3) r.w.s 153A of the Act and no new additions or disallowances except disallowance u/s.43B of the Act were made during the course of assessment proceedings u/s.153A of the Act, said addition also not emanating out of the search action. The Ld. AO has failed to appreciate the fact that no penalty was initiated with respect to the additions made by the AO vide order passed u/s.143(3) of the Act itself and same additions being made subsequently, could not call for penalty being initiated, leave alone being levied, since the same was resulting out of the original assessment and no fresh or new finding had led to the said addition being framed in the new proceedings initiated and completed u/s.143(3) r.w.s. 153A of the Ac t. Being aggrieved by the levy of the said penalty, the company is preferring an appeal in the present case.MoreLess
